Asters has successfully defended PrivatBank in a dispute over the title to Pryozernyi, a shopping mall in Dnipro with a total area of more than 32,000 square meters. The former owner of Pryozernyi was seeking to regain ownership of the shopping mall, referring to alleged illegality of the actions of the Bank and the state registrar in foreclosing on the shopping mall mortgaged to PrivatBank. The case has been pending in court since 2021. On 23 April 2024, the Supreme Court dismissed the former owner's cassation appeal, upholding the decisions of the first instance court and the court of appeal which confirmed the legality of PrivatBank's acquisition of the title to the property. Asters' litigation team working on the case included Co-Managing Partner Oleksiy Didkovskiy, Partner Andriy Pozhidayev, and Counsel Viktor Tarasenkov.

On 21-24 May 2024 Kyiv hosted FORUM EFBM 3.0 ‘From Recovery to Growth’. The event was held for the third time with the support of the Public Affairs Section of the U.S. Embassy in Ukraine. On 15 May 2024, the Law of Ukraine “On amendments to the Labour Code of Ukraine on employment relations in case of business entity transfer” entered into force. The new Law establishes additional guarantees to employees in the event of business transfer. Asters Counsel Inesa Letych and Associate Iryna Shaposhnikova analysed the main provisions of the law.

Asters has successfully defended PrivatBank in a case brought by the bank's former owners challenging its nationalisation. The case has been pending in court since 2019. The claimants challenged the PrivatBank shares sale and purchase agreement concluded as part of the nationalisation procedure, which made PrivatBank's shares fully owned by the state, and sought repossession of the Bank's shares. The court of the first instance closed the proceedings and confirmed the impossibility of returning PrivatBank to its former owners. On 14 May 2024, Asters, American Chamber of Commerce in Ukraine and Herbert Smith Freehills held a webinar on Carbon Border Adjustment Mechanism (#CBAM) tax for Ukrainian exporters of cement, iron and steel, aluminium, fertilizers, electricity and hydrogen, and some derivate goods. The speakers addressed the following topics: 💬 Global Head of ESG and Climate Change Practice Silke Goldberg and Consultant Eric White at Herbert Smith Freehills presented an overview of the EU ETS, CBAM, possible CBAM exemptions, different scenarios for negotiation of CBAM clauses. 💬 Pavlo Masiukov, GIZ, Support for the Establishment of an ETS in Ukraine Commission Manager, covered overview of potential scenarios for UA ETS launch. 💬 Andrii Kitura, PhD, Development Director in Dixi Group, Head of Green Transition Office in the Ministry of Economy of Ukraine, made a presentation on the development of the Government's position on CBAM, including on available options and current difficulties. 💬 Olha Yevstihnieieva, Decarbonisation Expert at Recovery and Reform Support Team at the Ministry of Energy of Ukraine, Advocacy Manager of Green Deal EU Reforms & Green Transition in Ukraine, spoke about the obtaining a derogation for the electricity sector according to CBAM Regulation in Ukraine. 💬 Asters' Partner Yaroslav Petrov moderated the event and Counsel Marta Halabala presented an overview of practical preparatory steps for Ukrainian exporters related to CBAM introduction.
